All You Need to Know About Partial Occupancy Certificate

The statutory local development authority issues an occupancy certificate when an apartment or property is taken possession of. This certificate allows a developer to allow buyers to occupy a property and is required for any structure with more than five apartments. This is an Occupancy Certificate, or OC as it is commonly abbreviated. But have you heard of the Partial Occupancy Certificate? If not, continue reading!

What is a Partial Occupancy Certificate

A Partial Occupancy Certificate is issued to large projects that are built in stages. After inspecting the structure, the concerned authorities (in the case of Bangalore, the BDA) grant it a Partial Occupancy Certificate. Similarly, as the next block completes, partial OC is issued to it. When the entire project is finished, Partial OC is replaced with a single common OC for the entire project. In a nutshell, a Partial OC allows only a portion of the finished residential project to be occupied.

Validity of Partial Occupancy Certificate

The partial OC is valid until the entire project is completed and the concerned authorities issue the Final OC.

What does the law state?

Section 5.7 of the Bangalore Building Bye-laws 2003 states that "No one shall occupy or permit any other person to occupy any new project or part of a new project for any purpose whatsoever until an officer authorised to issue such certificate has granted occupancy certificate to such project or part thereof if, in his opinion, the project is completed according to the sanctioned plans and ready for the use for which it is erected. In some exceptional cases, the relevant authority may grant partial occupancy for specific floors of a building." Simply put, once the project is completed, the developer must apply to the Statutory Authority (BBMP/ BDA) for an Occupancy Certificate.

Is the concept new?

It's not exactly new. However, as phased construction grows in popularity, so does the concept of the Partial Occupancy Certificate.

Are there any advantages of POC?

The most significant financial advantage is immediate possession. In contrast to OC, you can apply for an electricity or water connection with a Partial occupancy certificate.

You may not be able to get a home loan from a bank if you have a Partial Occupancy Certificate. Furthermore, you cannot apply for a khata certificate because it is only issued once you have an OC. As a result, a buyer must exercise extreme caution when selecting a project, especially if it is in blocks.

When to Apply for Partial OC?

Developers must apply for a Partial OC, like an OC, within 30 days of the tower's completion date. Requirements for obtaining a Partial Occupancy Certificate for a project:

Fire department clearance.
Waste management areas and composting amenities.
Rainwater harvesting facility.
Proper Sewage treatment plant.
Clearance from the Airports Authority of India (if the project is within the range of an airport).
Electrical inspectorate certificate, also one for lifts.
Just the basement and ground floor can be utilized for parking spaces.

Homebuyers must insist on obtaining a Partial Occupancy Certificate for residential projects that are being built in phases until the entire building is completed. Following that, buyers must insist on receiving an Occupancy Certificate from their builder.
